New Jersey’s drunk driving laws have undergone massive transformations recently. Under P.L. 2025, c.41 (which clarified and expanded on the 2024 updates), the state has fundamentally changed how license suspensions are handled, placing a heavy emphasis on Ignition Interlock Devices (IID).

Here is what you need to know about the new laws:

  • The “2-for-1” Ignition Interlock Credit: This is the most significant update for drivers. If you voluntarily install an IID prior to your conviction, you can now earn credit toward your mandatory license suspension. For every two days you have a compliant IID installed and maintain a restricted-use license, you earn one day of credit against your court-ordered suspension time. With early strategic action, this can drastically reduce—or completely eliminate—your time off the road.

  • Elimination of Mandatory Hard Suspensions (First Offenders): For first-time offenders with a Blood Alcohol Concentration (BAC) between 0.08% and 0.15%, the mandatory multi-month “hard” suspension has been eliminated provided you install an IID for the required time frame (typically 3 to 7 months).

  • Drug DUIs Remain Strict: It is important to note that the new IID lenient suspension rules do not apply to Drug DUIs (DUID). Because an interlock device cannot test for narcotics or marijuana, Drug DUIs still carry mandatory hard license suspensions ranging from 7 to 12 months for a first offense.
